A Federal High Court in Abuja has dismissed the suit brought before it by Aliyu Buba Gurin seeking the sack of Alhaji Adamu Mu’azu, as the national chairman of the Peoples Democratic Party, PDP and the reinstatement of the Bamanga Tukur, the immediate past chairman of the party.
The trial judge, Justice Evoh Chukwu, also threw out the counter claim filed by Tukur who was the second defendant in the suit, seeking his reinstatement.
The prayers of the plaintiffs were based on the grounds that Mu’azu’s appointment flouted the provisions of Section 45(1) and (2) of the party’s constitution.
Tukur also argued that his resignation from office on January 15, 2014 did not follow the provisions of the party’s constitution, which required that a 30-day pre-resignation notice must be given to the National Executive Committee of the party
Following the dismissal of the suit, Tukur said he would head to the Court of Appeal.
